The Violence Against Women Act

The Violence Against Women Act (VAWA) is a federal law which, in part, provides housing protections for victims of domestic violence, dating violence, sexual assault, and stalking who are living in or applying to live in units subsidized by the federal government.​ VAWA protects all survivors, regardless of their sex, gender identity, or sexual orientation AND regardless of the sex, gender identity, or sexual orientation of the person who caused harm.​

Protections for Victims

​If you are eligible for Public or Multifamily Housing or the Section 8 program, you cannot be refused admittance to the housing program on the basis that you are a victim of domestic violence, dating violence, sexual assault, or stalking.

You also cannot be evicted from public housing or terminated from Section 8 or any other housing assistance because you are a victim of domestic violence, dating violence, sexual assault, or stalking. Criminal acts directly related to the domestic violence, dating violence, sexual assault, or stalking caused by a member of your household or a guest cannot be the reason for an eviction or for termination of assistance if you were the victim of the abuse.

Reasons for Eviction or Termination

If there is a demonstrable actual & imminent (immediate) threat to other tenants or DCHA or property staff unless you are evicted, or your housing assistance is not terminated, you can still be evicted or have your housing assistance terminated. You may also be evicted or have your housing assistance terminated for serious or repeated lease violations or violations of program rules that are not related to the domestic violence, dating violence, sexual assault, or stalking. You may not be held to a more demanding set of rules than DCHA applies for tenants/program participants who are not victims.
